Charity in the application of punishment in Islamic law

Abstract

Our great religion, Islam, is the true religion of God, and its message is the best of the messages on the face of the earth. This great religion has commanded us to be kind in all matters, as the Most High said:  Indeed, God enjoins justice and benevolence  (1), and benevolence must be in all aspects of life. The Islamic Sharia embodied benevolence clearly in all its rulings, even in the application of penalties. God has enjoined the judgment of retaliation for the murderer if he kills one of the people unjustly, and he legislated this judgment in order to preserve the life of the people. In the application of retaliation is life for all people, because it deters the offender from his crime. Islamic Sharia obligated observance of benevolence when applying retribution on the offender in order to preserve his humanity, sanctity and dignity. And I loved to shed light on this bright side of our true religion, so I chose the topic of my research, which I called: (Ihsan in the application of retribution in Islamic law), so that it would be a clear picture showing the greatness of this religion and its mercy for people. And I chose this topic because of its utmost importance, as many people are ignorant of how to apply the rulings of God and act upon them, and because many people who hold the reins of affairs have misapplied retaliation and the limits set by God. And he avoided it. I made this research on: an introduction, two sections, and a conclusion. I spoke in the introduction on the importance of the topic, and my division of the research. In the first topic, I dealt with the definition of benevolence and its ruling. In the second topic, I dealt with: the method of retribution, and the forms of benevolence in it. As for the conclusion, I made it one of the most important results that I reached through the research. And last but not least, I ask God Almighty to make this work purely for His honorable sake, to accept it from me, to place it in the balance of my good deeds, to remove my slips and slips, and to help us to serve Islam and Islam.
