Abstract
Each of them performs the material role entrusted to him, and each of them has his own criminal will that is directed towards violating the right protected by the law, that is, towards realizing the crime and bringing it into existence. And this is what called for some legislations to remove incitement from the scope of criminal participation, and to stipulate it separately, and to consider the instigator as the perpetrator, and if we carefully considered the instigator, it would not be possible to describe him as a perpetrator of the crime because he does not contribute to its implementation, nor is it justified to say That the activity of the instigator is consequential to the activity of the original perpetrator of the crime, because this instigator is what creates the criminal design in the mind of the perpetrator (3)
